Wills, Estates & Probate

Probate and Estate Administration

If a loved one has passed away and they owned real estate or other large assets, then you in your capacity as Executor may have to obtain Probate to carry out the directions in your loved one's Will.

Probate is a legal document and the application is a detailed process. If you are an Executor named in a Will we recommend that you contact us to prepare the Probate application.

By having a valid Will you ensure that your personal effects and assets will be distributed in the way that you want them to be following your death.

A Will allows you to appoint a person of your choice to be the Executor of your Estate. Your Executor is then in charge of administering your Estate in accordance with the terms of your Will. A valid Will also enables you to nominate a guardian to care for your children.

If you were to die without a valid Will, then the law determines how your assets are distributed. This can not only cause considerable expense, but may also result in your assets being distributed to relatives who you had little or no contact with.

Enduring Power of Attorney

An Enduring Power of Attorney is a legal document which forms an integral part of your estate planning. It is important for you to choose and then appoint a person to properly manage your assets and financial affairs if you are unable to do so for reasons such as an accident, illness or if you are going interstate/overseas.

Enduring Power of Guardianship

An Enduring Power of Guardianship is a legal document where you give directions to a person of your choice relating to your future lifestyle and medical treatment. It comes into effect when you lose mental capacity due to illness, accident or other event. If you would like Bosnich Legal to prepare any of the above for you, phone us on (08) 8233 5989.
